Small Business Restructure

A Small Business Restructure (“SBR”) permits Directors to retain control of the business while a restructuring plan is developed over the 20-business-day period following commencement by a SBR practitioner.  

 

This is a government introduced initiative to help support small businesses go through a structured negotiation with creditors where total liabilities are less than $1 million  There are requirements you have to meet to qualify such as employee super payments 'up to date' and no related creditors participating in the distribution (things we can explain) but the goal is that this process helps businesses have an alternate solution.  

 

The directors continue to remain in control of the business whilst pre-appointment creditors are temporarily put on hold, whilst we assist you with proposing a go forward plan.  If the proposed plan to compromise and reduce the company debt is accepted by the majority who vote on it (and once all payments under the plan are complete), the company is released from all creditor debts that were subject to the plan.  A solution that is not an administration or liquidation but will see your business find a path quicker, cheaper and easier than alternate options available.

Data released by the ASIC indicates that 92% of proposed restructuring plans sent to creditors were approved with 66% of companies that implemented a restructuring plan appearing to continue operating as a going concern, evidence that an SBR may be a valuable solution for your business where otherwise it may have ceased trading.

The consequences can be severe and you can become personally responsible for company debts, and subject to claims by the liquidator and we see too many people lose personal assets because they haven't put their hand up earlier enough to get help to solve the business debt problems.

A creditors voluntary liquidation requires that the company is insolvent but despite its title, cannot be initiated by creditors. A creditors voluntary liquidation is initiated when the members of the company resolve, by special resolution, that the company be wound up following the Director(s) determining that the company is insolvent and should be wound up
